CORT is a service provided to residential customers of Irvine Management Company and its affiliates (collectively, “Irvine Company”) for your convenience.  Irvine Company’s affiliates include without limitation the entities that own and operate the properties in which you are customer and other entities that may be affiliated with Irvine Company.  In consideration of access to the CORT program or special offers, you acknowledge and agree that you are dealing directly with CORT, and any issues concerning CORT are solely between you and CORT. Irvine Company is not responsible or liable for your use of the services provided by CORT. To the extent you provide any personal information, such personal information is provided to CORT. CORT is an independent business and not an agent of Irvine Company. The content on the CORT website is owned by CORT and use of their site is governed by CORT’s Terms of Use and Privacy Policy.  On behalf of yourself and your representatives, agents, heirs, executors, administrators and assigns, you hereby release Irvine Company and each of its officers, directors, employees, agents, representatives, subsidiaries, affiliates, and all those acting in conjunction with or under the authority of Irvine Company or any of them, from and against all claims, damages, losses, injuries, death or liability of any kind arising from or relating, in whole or in part, directly or indirectly, to your dealings with CORT and their service. You acknowledge that you are familiar with the provisions of California Civil Code § 1542, which provides as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”  Being aware of said code section, you hereby expressly waive any rights you may have thereunder, as well as any other statute or common law principles of similar effect.
